1. Acceptance of Terms
By accessing or using Guardget ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the Platform.
2. Description of Service
Guardget provides gadget vendors with tools for inventory management, sales documentation, receipt generation, and stolen device reporting. The Platform also offers public device verification services.
3. Vendor Accounts
- You must provide accurate business information when creating an account
- You are responsible for maintaining the confidentiality of your credentials
- You must notify us immediately of any unauthorized use of your account
- You may not share your account with others or create multiple accounts
4. Blacklisting Responsibilities
The blacklist feature is provided for legitimate reporting of stolen or missing devices. By using this feature, you agree to:
- Only report devices you have legitimate ownership claims to
- Provide accurate incident information
- Not use the blacklist for fraudulent purposes
- Accept that blacklist records are permanent for legal reference
False or malicious blacklist reports may result in account termination and potential legal action.
5. Data Collection and Privacy
When collecting buyer information during sales, you are responsible for:
- Obtaining appropriate consent from buyers
- Explaining why their information is being collected
- Complying with the applicable data protection laws in your jurisdiction
- Using buyer data only for its intended purpose
6. Receipts and Documentation
Receipts generated through Guardget are for documentation purposes. While they provide evidence of transactions, they do not constitute legal proof of ownership transfer. Vendors remain responsible for their own legal compliance.
7. Device Verification Disclaimer
The device verification service checks our internal blacklist database only. A "clear" result means the device has not been reported through Guardget. We do not guarantee that a device is not stolen if it has not been reported to our platform. Users should perform additional due diligence before purchasing devices.
8. Limitation of Liability
Guardget provides tools to help vendors manage their businesses and protect against fraud. However, we are not responsible for:
- Losses from fraudulent transactions
- Accuracy of information provided by vendors
- Disputes between vendors and buyers
- Recovery of stolen devices
9. Account Termination
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or misuse the blacklist feature. Upon termination, your data may be retained for legal compliance purposes.
10. Changes to Terms
We may update these terms from time to time. Continued use of the Platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via email.
11. Governing Law
These terms are governed by the applicable laws of the jurisdiction in which you operate. Any disputes shall be resolved in the competent courts of the applicable jurisdiction.
